COPYRIGHT & ARTWORK AUTHENTICITY POLICY — ETIUART

1. Introduction
This Copyright & Artwork Authenticity Policy (the “Policy”) governs issues related to copyright, authenticity, provenance, and ownership of artworks presented and sold through https://etiuart.am/ (the “Website”).
The Website is operated by ETIUART LLC (ETIUART ՍՊԸ), a legal entity registered under the laws of the Republic of Armenia. Throughout this Policy, the company is referred to as “ETIUART”, “we”, “our”, or “us”.
ETIUART is an international art platform dedicated exclusively to the presentation and sale of original, authentic, and exclusive artworks. This Policy is intended to ensure transparency, protect artists’ rights, and provide collectors with clear assurances regarding the authenticity and legal status of artworks acquired through the platform.
2. Originality and Exclusivity of Artworks
All artworks offered for sale on ETIUART are original and exclusive works of art.
Each artwork:
- exists as a single, unique physical piece,
- has no identical copy, duplicate, or second version, and
- is created as a standalone artistic work.
ETIUART does not offer mass-produced artworks or replicas. Where applicable, any specific characteristics or artistic techniques are disclosed in the artwork description.
3. Provenance and Source of Artworks
Artworks presented on ETIUART are made available based on direct contractual arrangements with artists.
Key principles:
- Artworks are not resold secondary-market works.
- Artworks are introduced to the market through ETIUART for the first time.
- ETIUART holds the exclusive right to present and sell the artworks offered on the Website for the duration of the applicable agreements.
This structure ensures clear provenance, transparent origin, and controlled distribution.
4. Artwork Authenticity
ETIUART guarantees that all artworks sold through the platform are authentic.
Authenticity is established through:
- direct sourcing,
- artist confirmation,
- internal verification procedures, and
- accompanying documentation.
ETIUART takes reasonable measures to prevent the sale of counterfeit, misrepresented, or unlawfully sourced artworks.
5. Artwork Passport and Certificate of Authenticity
Where applicable, each artwork may be accompanied by an Artwork Passport prepared by ETIUART.
The Artwork Passport may include:
- title of the artwork,
- name of the artist,
- year of creation,
- medium and materials,
- dimensions,
- brief description or concept,
- confirmation of originality.
In addition, a Certificate of Authenticity may be provided, issued by the artist or prepared in collaboration with ETIUART, serving as formal confirmation of the artwork’s authenticity and origin.
Collectors are encouraged to retain all documentation for provenance, archival, and future reference purposes.
6.Copyright and Intellectual Property Rights
6.1 The purchase of an artwork through ETIUART transfers ownership of the physical artwork only.
Unless explicitly agreed otherwise in writing:
- copyright remains with the artist,
- moral rights remain with the artist, including the right to attribution and protection against distortion or misuse.
6.2 The buyer may not:
- reproduce the artwork,
- create derivative works,
- use the artwork for commercial purposes,
- distribute images of the artwork for marketing or resale,
without prior written permission from the artist or rights holder.
6.3 Digital Reproductions and Copies
Unless explicitly authorized in writing by the artist and/or ETIUART, the buyer is strictly prohibited from creating, selling, distributing, minting, or otherwise commercializing any digital copies, reproductions, scans, photographs, or digital representations of the artwork, including but not limited to digital prints, online publications, or blockchain-based assets (such as NFTs).
This restriction applies regardless of whether the digital copy is altered, enhanced, or presented as a new or derivative work.
7. Permitted Use by Collectors
Collectors are permitted to:
- display the artwork privately or publicly (e.g., home, office, non-commercial exhibitions),
- resell the physical artwork as permitted by law,
- reference ownership for non-commercial purposes.
Any reproduction, publication, or commercial exploitation requires explicit authorization.
8. Website Content and Images
All content on the Website, including:
- images of artworks,
- texts,
- curatorial descriptions,
- graphic elements,
is protected by copyright and other intellectual property laws.
Website content may not be copied, reproduced, or used without prior written permission from ETIUART or the relevant rights holders.
9. Visual Representation Disclaimer
Visual Perception and Artistic Presence
ETIUART strives to ensure that all photographs and images accurately represent the true colors, textures, and details of artworks. Every reasonable effort is made to capture each piece as faithfully as possible.
However:
- variations in screen settings, device displays, and lighting conditions may result in minor differences in appearance;
- the emotional presence, scale, and tactile qualities of a live artwork cannot always be fully conveyed through digital images.
Such variations are inherent to artistic works and do not constitute defects or grounds for claims.
10. Packaging, Documentation, and Presentation
Artworks are prepared for shipment by specialized professional packaging providers experienced in handling artworks.
Each shipment may include:
- secure technical packaging for protection during transit,
- an exclusive fabric bag provided separately within the package for elegant presentation,
- an official Artwork Passport issued by ETIUART,
- accompanying documentation required for transportation and compliance,
- a personalized letter from the artist attached to the package (not placed inside the fabric bag).
These elements are designed to enrich the collector’s experience and reinforce authenticity and provenance.
11. Cultural and Handmade Nature Disclosure
Artworks offered through ETIUART are created through artistic processes that may involve manual, experimental, or culturally specific techniques.
Natural variations in texture, material, form, or finish are inherent to original artworks and are considered integral to their artistic value.
12. Limitation of Guarantees
All artworks presented and sold are original, unique, and exclusive. While ETIUART undertakes reasonable efforts to verify the authenticity and provenance of all artworks, ETIUART does not guarantee, warrant, or make any representation regarding artistic value, future market value, resale value, appreciation, or investment performance of any artwork.
13. Amendments
ETIUART reserves the right to amend this Policy at any time.
Updated versions will be published on the Website with a revised date.
Continued use of the Website constitutes acceptance of the updated Policy.
